Quarterly Filer ("we", "us", "our") provides software that helps self-employed people and landlords meet their Making Tax Digital for Income Tax obligations with HMRC. "You" means the person who holds a Quarterly Filer account.

Clause 1

1. The service we provide

Quarterly Filer lets you keep digital records of your income and expenses and submit your quarterly updates and final declaration to HMRC through their official Making Tax Digital service.

We'll take reasonable care to keep the service available, accurate and secure. We can't promise it will never be unavailable, for example during maintenance or matters outside our control, but we'll always aim to keep any disruption short.

Clause 2

2. Your account and responsibilities

You're responsible for the information you put into Quarterly Filer. The figures you file with HMRC are only as accurate as the income and expenses you enter, so please check them before you submit. You review and confirm every submission before it goes to HMRC.

Please keep your login details secure and don't let anyone else use your account. Let us know straightaway if you think someone has gained access to it.

Clause 3

3. Subscription and payment

Quarterly Filer costs £49 a year, one payment that covers the tax year. A £18 one-off single submission is also available if you only need to file once. The annual plan renews automatically each year until you cancel, and payment is taken in advance for the coming period. The one-off submission is a single charge and does not renew.

Your first quarterly update is free. You can set up your account and file your first quarterly update to HMRC without paying, and your annual plan or one-off charge begins after that. There are no setup fees and no hidden charges.

If a payment fails, we'll try to take it again and let you know. If we can't collect payment, we may pause your access until the account is up to date.

Clause 4

4. Cancelling

You can cancel at any time from your account, with no minimum term and no cancellation fee. Your subscription will run until the end of the period you've already paid for, and you won't be charged again after that.

We don't generally give refunds for part of a month, as you keep access until the paid period ends. If you cancel, you can still ask us for a copy of your records (see our privacy policy).

We may suspend or close an account if these terms are seriously or repeatedly broken, for example misuse of the service or non-payment. Where we reasonably can, we'll warn you first.

5. What the service is, and isn't

Quarterly Filer is software that helps you file, not an accountancy or tax advice service. We don't provide tax, legal or financial advice, and nothing in the service should be taken as such. If you need advice about your particular situation, please speak to an accountant or a qualified adviser.

Responsibility for your tax affairs, including what you report and paying what you owe, remains with you. That's the case with HMRC whether or not you use software.

Clause 6

6. Our liability

We take real care with the service, but there are limits to what we can be responsible for. We're liable to you for loss we cause you through breaking these terms or failing to use reasonable care, but we're not responsible for:

  • Indirect or unexpected losses, meaning losses that don't naturally follow from our failure and that neither of us could reasonably have foreseen.
  • Loss caused by your own figures, for example a penalty from HMRC because of information you entered incorrectly.
  • Problems outside our reasonable control, such as HMRC systems being unavailable, internet outages or events we couldn't reasonably prevent.

Where we are liable, our total responsibility to you is limited to the amount you've paid us in the twelve months before the problem arose. This reflects the fact that Quarterly Filer is a low-cost tool, not a professional adviser carrying professional indemnity.

Nothing in these terms limits any liability that can't be limited by law, such as liability for death or personal injury caused by our negligence, or for fraud.

Clause 7

7. Changes to the service or these terms

We may improve or change the service over time, and we may update these terms, for example if the law or HMRC's requirements change. If we make a significant change to the terms, we'll let you know by email or through the service before it takes effect.

If you continue using Quarterly Filer after a change, you accept the updated terms. If you don't agree with a change, you're free to cancel.

8. Your data

How we handle your personal information is set out in our privacy policy, which forms part of your agreement with us. It explains what we collect, how we store it and the rights you have.

Clause 9

9. Governing law

These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you may be able to bring a claim in your local courts.
